The Special Prosecutor has been berated in open court for filing a court process when they had not read the full ruling on the matter.
Presiding judge, Justice Nicholas Mensah Abodakpi of the High Court in Accra (Human Rights Division) was furious asking the OSP staff to up their game.
This comes days after the OSP Kissi Agyebeng accused the judiciary of ganging up against his office to frustrate the fight against corruption.
The OSP represented in court by a Prosecutor Staff member of the office named Seth Ansong was Queried by Justice Abodakpi why he was making depositions on a ruling he had not read.
The judge asked the OSP rep “if you have read the ruling of the court earlier before making those depositions in paragraphs 21, 22 and 23”.
The OSP officer Seth Ansong admitted he ignorance of the ruling saying “Not that I know of.”
The court struck out the paragraphs 21, 22, 23and said if the OSP had read the ruling, it wouldn’t have been included.
Justice Abodakpi proceeded to describe as “scandalous” the depositions made by the OSP.
The case before the court concerns an affidavit in answer to a human rights action filed by former Secretary to the dissolved Inter-Ministerial Committee on Illegal Mining (IMCIM) Charles Cromwell Bissue.
The OSP has faced accusations of using “fast food” style prosecution tactics leading to judges dismissing the office’s arguments when presentations to the bench are submitted.
The OSP has also been accused of Absenteeism and incompetence. In one case, the OSP failed to file its Affidavit in answer Charles Bissue after 36 days despite repeated notice from the court.
Per the rules, the OSP was to file its affidavit in answer to Bissue within 21 days upon service but after 36 days, failed to file anything in the case. At the time the SP Kissi Agyebeng was said to be in Singapore.
Charles Bissue and his lawyers had dragged the OSP (First Respondent) and attached the Kaneshie District Court (2nd Respondent) to the suit as he raised issues for the enforcement of his fundamental human rights.
However, in a press conference convened by the OSP, Kissi Agyebeng said the spate of court losses by his office is the judiciary ganging up against him with “regressive and dismissive” decisions.
The OSP who has also faced allegations of cronyism and favouratism in the recruitment of Staff for his office said if the conduct of the judiciary is not checked, it will hurt Ghana’s fight against corruption.
The OSP cited four instances he believes supports his theory of seeming Judicial bias against the office.
